Possessing or administering controlled dangerous substance. Maryland Criminal Law 5-601: Possession of marijuana in Maryland is classified as a misdemeanor and upon conviction a person is subject to 1 year incarceration or a fine not exceeding $1,000.00 or both.

Possession of non-marijuana in Maryland is classified as a misdemeanor (heroin, cocaine, crack, or any controlled dangerous substance as defined in Maryland Criminal Law 5-601) and upon conviction a person is subject to 4 years incarceration or a fine not exceeding $25,000.00 or both.

Baltimore County, Maryland Drug Possession with Intent – Penalties

If you are charged in Baltimore County, MD, with possession with intent to distribute, drug distribution, or manufacturing a controlled dangerous substance, Maryland law provides that you will be charged with a felony.

If you are charged with possession with felony intent to distribute, drug distribution, or manufacturing a controlled dangerous substance, to wit Marijuana then you could be facing a maximum penalty of 5 years or a fine not exceeding $15,000.00 or both.  This includes any drugs that are not Schedule I or Schedule II.

If you are facing charges of possession with intent to distribute, drug distribution, or manufacturing a controlled dangerous substance of a Schedule I or Schedule II drugs, then you are facing felony drug charges.  Examples of Schedule I or Schedule II substances are heroin, methamphetamine, cocaine, crack, LSD, and other dangerous drugs and controlled dangerous substances.

Schedule I and Schedule II penalties are:

First offense, felony and on conviction is subject to imprisonment not exceeding 20 years or a fine not exceeding $25,000.00 or both.

Second offense, felony and on conviction is subject to imprisonment for not less than 10 years and is subject to a fine not exceeding $100,000.00 if the person has previously been convicted once before.

Third offense, felony and on conviction is subject to imprisonment for not less than 25 years and is subject to a fine not exceeding $100,000.00

Fourth offense, felony and on conviction is subject to imprisonment for not less than 40 years and is subject to a fine not exceeding $100,000.00.

Police first received a report of a fight at 1:29 a.m. at Boomers Bar & Smokehouse, in the 100 block of Earls Road, police said.

Chief Johnson Concerned About Disturbances at Nightclub: "Baltimore County, Md. (July 7, 2011) - Baltimore County police are working with the owners of Club Baltimore, the White Marsh nightclub where a man was shot to death last weekend, to reduce the number of disturbances and noise complaints.

Police Chief James Johnson said that he is prepared to act against the club if conditions there do not improve.

'We hope that the owner of Club Baltimore will cooperate with Precinct 9's efforts to improve conditions there,' Johnson said, noting that the owner, Harjeet Singh Multani, has been cooperating with police. 'But we are looking at taking action against the club if that does not happen.'

Firefighters were first called at 3:57 a.m. to an apartment building in the 2600 block of Sparrows Point Road after a resident heard a popping noise outside his apartment and saw smoke and flames at the rear of the building, police said."

Shawn Allen Novak, 28, of Baltimore and Ann Marie Preston, 27, of Dundalk, were arrested Monday and face first- and second-degree assault charges, after officers were called about 10 p.m. Sunday to the 6800 of Broening Road in Dundalk for reports of an assault. Homicide at Nightclub Under Investigation: "Baltimore County, Md. (July 5, 2011) - Baltimore County Police are investigating a homicide that occurred at Club Baltimore in the 8000-block of Pulaski Highway, 21237 on July 2.
On July 2 at 1:50 a.m., officers responded to Club Baltimore for a call of shots fired. Officers observed George William Bryant Jr., 36, of the 1500-block of Pentwood Avenue, 21239 lying on the parking lot at the club. The victim had been shot multiple times. He was transported to Johns Hopkins Bayview Medical Center, where he was pronounced deceased.
The suspect is described as a black male between 20-30 years old. He may have left the location in a vehicle."

Arrests in Assault Case: "Baltimore County, Md. (July 5, 2011) - Baltimore County Police have charged Shawn Allen Novak, 28, of the 600-block of Arsan Avenue, 21225 and Ann Marie Preston, 27, of the 4100-block of North Point Road, 21222 with first and second degree assault after an incident in Precinct 12/North Point on July 3. The incident was originally reported as an attempted robbery but was determined to be a first degree assault after investigation.
On July 3 at approximately 10 p.m., officers responded to the 6800-block of Broening Road, 21222 for a report of an assault. A 32-year-old male victim was found with cuts to his upper body as a result of the incident. He was transported to Johns Hopkins Bayview Medical Center for treatment."

George William Bryant Jr., 36, of Pentwood Road was shot multiple times in the head and neck in the parking lot of Club Baltimore at 8014 Pulaski Highway in the Rosedale area, according to police.
